On the BIS Entity List: exports to it need a US license, which is presumed denied. Listed as Semiconductor Manufacturing International Corporation (SMIC), SMIC Advanced Technology R&D (Shanghai) Corporation, and Semiconductor Manufacturing International (Beijing) Corporation. Incorporated in China, which makes it a foreign entity of concern under the CHIPS rules (15 CFR 231.104). On the Treasury's NS-CMIC list of Chinese military companies, which by itself makes it a foreign entity of concern under the CHIPS rules (15 CFR 231.104(f)). US investment limits also apply. Named in Section 5949 of the FY2023 NDAA: from Dec 23, 2027, US federal agencies may not buy products that contain its chips. On the Defense Department's 1260H list of Chinese military companies. The department may not contract with it from Jun 30, 2026, and the ban covers goods and services from Jun 30, 2027.
